Rick,

I'm sorry - I did not notice the question was about NC313L, not the NC353L.

Thee button does not do anything when the camera is booted, it only matters
if you hold it while inserting the cable (and so providing power) - in that
case camera goes to reflash mode. And sure all those links I gave you are
only applicable to the NC353L.

Can you find out - what is the firmware version? You can find that it if you
telnet to the camera (login:root, password:pass) and enter
cat /etc/issue

You may also run
dmesg
and copy the output, compress and attach to email

"Camera in use" - there were many ways how to get camera there - can you
reboot the camera, get black image (not "camera in use") and look at it in
any image-processing software - are all the pixels completely zeros?
